BABYSITTER CONTRACT

This Babysitter Contract (the "Contract") is entered into on   (the "Effective Date") by and between

 , having their usual place of living at   (the "Family"), and 

 , having their usual place of living at   (the "Babysitter"), collectively referred to as the "Parties" and each individually as the "Party".

WHEREAS the Family requires the Services and the Babysitter has agreed to provide them for the Family based on the terms and conditions set forth in this Contract;

NOW, THEREFORE, in consideration of the mutual promises and obligations set forth herein and upon other good and valuable consideration, the Parties have agreed as follows:

SUBJECT TO THE CONTRACT. This Contract governs the terms and conditions of providing childcare services for the Family by the Babysitter as set forth below:

Services. The Babysitter will provide the following childcare services (the "Services") for the Family's Baby  ,   (the "Baby"):

Work schedule. The Babysitter will provide the Services on:

The Family may request that the Babysitter work additional hours, with reasonable notice and provided that the Babysitter is able to work. 

COMPENSATION. The Family shall pay the Babysitter a compensation of   per hour (the "Compensation"), which shall be paid weekly by cash.

The Compensation shall be inclusive of the actual hours worked.

Any applicable taxes are included in the Compensation, and the Babysitter is responsible for reporting their wages to the IRS and the State.

The Family shall reimburse the Babysitter for reasonable additional expenses necessary to provide the Services, including:

JOB RESPONSIBILITIES OF THE BABYSITTER. The Babysitter shall maintain a professional demeanor at all times, including: 

The Babysitter understands and acknowledges that the above scope of Services is not exhaustive and that they may be required to provide other Services from time to time as directed by the Family and mutually agreed upon by the Parties in verbal form, provided that such duties are reasonable and within their abilities and experience.

The Babysitter shall not be under the influence of alcohol or drugs.

OTHER TERMS.  

TERM AND TERMINATION OF THE CONTRACT. This Contract shall commence on the Effective Date and shall continue until   unless terminated earlier in accordance with the terms of this Contract.

Either Party may terminate this Contract at any time, with or without cause, upon   days written notice to the other Party.

Notwithstanding the foregoing, either Party may immediately terminate this Contract under the Termination for Cause.

Upon termination of the Contract, the Babysitter shall return to the Family all property, materials, and equipment belonging to the Family, including but not limited to keys, credit cards, and any other property or equipment provided by the Family.

TERMINATION FOR CAUSE

A. Termination by the Family. The Family may immediately terminate this Contract on the following grounds:

The decision to terminate this Contract for cause shall be made at the sole discretion of the Family. The Babysitter acknowledges that if they are dismissed for cause, they shall not be entitled to any further compensation. The Babysitter also acknowledges that in the event of termination for cause, they may be held liable for any damages incurred by the Family or the Baby due to the Babysitter's actions or inactions.

B. Termination by the Babysitter. The Babysitter may immediately terminate this Contract, including on the following grounds:

The Family acknowledges that if the Contract is terminated for cause by the Babysitter, the Babysitter shall have the right to receive any unpaid wages or other compensation due and owing under this Contract. The Family further acknowledges that if the Contract is terminated for cause by the Babysitter, the Family may be held liable for any damages incurred by the Babysitter due to the Family's actions or omissions.

CONFIDENTIALITY. The Parties agree to keep all information disclosed during this Contract confidential and not to share such information with any third party unless required by law. The Parties agree not to use the confidential information for any purpose other than what is necessary to fulfill their obligations under this Contract.

This confidentiality clause shall survive the termination or expiration of this Contract.

NOTICE. Any notice, request, demand, or other communication required or permitted under this Contract shall be sufficiently given if delivered in person or by certified mail, return receipt requested, to the address set forth in the opening paragraph or to the other address as one Party may have furnished in writing, or to email addresses set forth below:

GOVERNING LAW AND DISPUTE RESOLUTION. This Contract shall be governed by and interpreted in accordance with the laws of the State of  , and any disputes arising out of or in connection with this Contract shall be exclusively resolved by the courts of the State of  .

SEVERABILITY. The invalidity or unenforceability of any provision of this Contract shall not affect the validity or enforceability of any other provision of this Contract.

ASSIGNMENT. Neither Party may assign or transfer this Contract without the prior written consent of the non-assigning Party, which approval shall not be unreasonably withheld.

ENTIRE AGREEMENT. This Contract represents the entire agreement between the Parties and supersedes any prior oral or written agreements.

WAIVER. The failure of any Party to enforce a particular provision of this Contract shall not constitute a waiver of their right to enforce that provision in the future.


AMENDMENTS.
This Contract may be amended or modified only by a written agreement signed by both Parties. Any amendments to this Contract shall be binding only if they are in writing and signed by both Parties.

BINDING EFFECT. This Contract shall be binding upon the Parties and their respective successors and assigns.
