A general release of liability form is a document through which one party agrees not to hold another party responsible for any potential injuries, damages, or losses that may take place during a specific activity or transaction. 

When To Use a Release of Liability Form

A general liability release form is often used when someone participates in an event or activity that could be risky.

Common situations

  • Sports or fitness activities (e.g., gyms, marathons, extreme sports);
  • When selling a used car;
  • As part of a settlement agreement in legal disputes;
  • Before allowing someone to be photographed or recorded for media purposes;
  • When obtaining medical records with patient permission.

When not to use a release of liability form:

A simple release of liability form cannot protect against all legal claims. It cannot be used: 

  • In cases of gross negligence or intentional harm;
  • To pass responsibility that legally cannot be waived (e.g., employer responsibilities for workplace injuries);
  • In situations that involve minors, unless the document is signed by a parent or guardian;
  • If the agreement violates public policy or laws. 

How To Fill in a Release of Liability (Waiver) Form: Step-by-Step

Step 1: Identify the parties

  • Write the full name, address, and contact information of the person protected from liability in “The Releasee” section;
  • Write the full name, address, and contact information of the person who gives up liability in “The Releasor” section.

Step 2: Describe the activity or event

  • Identify the purpose of the event in the “Activity” section of the waiver form;
  • Name the activity;
  • Write the date and time when the activity will occur;
  • Add the information about the location where the activity will take place.

Step 3: Specify the risks or responsibilities being waived

  • Enumerate the risks assumed in the “Acceptance of risks” section.

Step 4: Identify actions in case of emergency

  • Add the name of a person who can be reached in an emergency in the “Emergency medical treatment” section.
  • Provide the phone number of the responsible person.

Step 5: Additional terms

  • Name the state of the laws that will apply to the agreement in the “Governing law” section.
  • Choose the state where the court will initiate proceedings if the parties breach the agreement in the “Jurisdiction” section.
